Arizona Texting-While-Driving Ban Takes Effect in 2021

PHOENIX — Although the distracted driving law doesn't go into effect until 2021, drivers in Arizona can still be pulled over by police for warnings.

Gov. Doug Ducey signed House Bill 2318 into law while surrounded by advocates, law enforcement and lawmakers Monday.

Once enforcement begins in earnest, it will be illegal to “physically hold” or “support with any part of the body” any cellphone or other "portable wireless communication device while operating a motor vehicle."

There was no resolution, however, on what makes up "support" of a phone, according to the Arizona Daily Star. Would drivers with a phone on their lap be in violation? That remains unclear.

There are exceptions to the no-phone law. Drivers who are stopped at a light or waiting for a train are legally allowed to handle a device, but a stop sign does not count.

Violators will pay a minimum $75 fine for the first offense and a up to $250 for the second. No points are counted against an accused driver, but licenses can be suspended if an offense causes injury or death.
