About the Position
The Appeals Prosecutor is responsible for handling cases at the post-conviction level as well as special actions.
This recruitment is utilized to fill Prosecutor levels I – III positions. The level and compensation offered will be based on the education and experience provided in the application.
- Prosecutors hired at a level I will be compensated at a range of $61,484.80 - $66,206
- Prosecutors hired at a level II will be compensated at a range of $72,467 - $84,053
- Prosecutors hired at a level III will be compensated at a range of $90,189 - $121,306

Position Qualifications

Education
- Juris Doctor (JD) from an accredited and American Bar Association (ABA) approved law school
Other Requirements
- Must be admitted to practice law and be in good standing with the State Bar of Arizona by the time of hire
- Must currently possess and have the ability to obtain a valid Arizona Driver's License at time of hire
- May be required to travel to perform certain work functions

Essential Job Tasks
The tasks listed are a representation and not an all-inclusive list of essential job tasks for this position.
- Composes memoranda and pleadings regarding legal issues of concern as needed in assigned cases
- Handles felony post-conviction litigation, juvenile appellate litigation, lower court appeals in Superior Court, special actions, and other litigation before the Arizona Court of Appeals, Arizona Supreme Court, and U.S. Supreme Court
- Researches and analyzes legal issues using both computerized legal research and hard copy tools
- Represents the State in probation violation court proceedings regularly, including making appropriate disposition recommendations and responding to both oral and written motions when necessary
- Responds to written post-conviction motions and petitions including but not limited to Rule 32 post-conviction relief, commutation of sentence applications, motions to modify probation terms, and motions to restore civil rights
- Complies with all rules regulating professional responsibility, including specific rules addressing the prosecution function
- Maintains professional relationships with victims, witnesses, law enforcement agencies, and members of the community
- Conducts and supervises evidentiary hearings and presents oral arguments as needed
- Discusses and presents analysis of criminal legal issues with trial attorneys, supervisors, and the County Attorney
- Negotiates the resolution of assigned cases in compliance with Victims' Rights and covers court and other duties as assigned
Selection Procedure
The Maricopa County Human Resources Department reserves the right to admit to the selection process only those candidates considered to be the most highly qualified. Those selected will be assessed based on the evaluation of listed education and experience. The hiring authority will interview and select the successful candidate from a list provided by Human Resources.

A background investigation is conducted on a current employee who changes to a Safety Sensitive Position or one having the potential for serious adverse impact on the integrity or efficiency of the County. These requirements do not pertain to employees of elected officials who undergo background investigation processes administered through their respective offices.
Typically, successful candidates are hired at a salary rate up to the midpoint of the range, based on relevant experience, internal equity, and budgetary allowances.
