Erika Jayne And Ex-Husband Sued For 'Sham' Divorce

A class-action suit accuses Erika Jayne and her ex-husband of faking their divorce and embezzling funds from clients.

BEVERLY HILLS, CA — A new class-action lawsuit alleges that Real Housewife of Beverly Hills Erika Jayne's divorce from her husband Thomas Girardi is a "sham" to hide embezzled money.

Edelson PC, a class-action firm, filed a suit Wednesday alleging that Girardi and his firm Girardi Keese stole millions of dollars that were supposed to go to surviving relatives of the Oct. 2018 Lion Air 610 plane crash, which killed all 189 passengers shortly after taking off from Jakarta, Indonesia.

The suit alleges that Girardi and his firm, which was representing the families of the victims, find themselves "on the verge of financial collapse and locked in a downward spiral of mounting debts and dwindling funds" and have therefore resorted to taking money from settlement funds owed to victims "in order to continue funding his and Erika's lavish Beverly Hills lifestyles."

Jayne, 49, divorced Girardi, 81, last month, citing irreconcilable differences. The suit alleges that the divorce is "simply a sham attempt to fraudulently protect Tom’s and Erika’s money from those that seek to collect on debts owed by Tom and his law firm GK."

The suit points to the couple's "lavish" lifestyle, alleging that Jayne has said she spends $40,000 a month on clothing. The suit also cited her song "Xxpen$ive," which include the lyrics, "It's expensive to be me....Looking this good don't come for free."

Neither Jayne nor Girardi have commented publicly on the allegations. The only semi-comment came from Jayne, who posted a cryptic message on Twitter Wednesday. The reality star, actor, and chart-topping singer posted a photo of herself in a couture black dress with the caption "High Drama."

The couple met in the 1990s when Jayne was a cocktail waitress at the Los Angeles restaurant Chasen's, a now-shuttered West Hollywood haunt frequented by Hollywood high-rollers. The couple married and 1999, and divorced on Nov. 3 of this year.

"After much consideration, I have decided to end my marriage to Tom Girardi," Jayne said in a statement. "This is not a step taken lightly or easily. I have great love and respect for Tom and for our years and the lives we built together."

Though the couple did not have a prenuptial agreement in place, Jayne asked in her divorce filing to be paid spousal support.
