A driver was killed after being ejected from their car when it was rear-ended by a suspected drunk driver, authorities said.

CUPERTINO, CA —A 22-year-old man has been arrested on suspicion of being under the influence of alcohol in a fatal crash on southbound Interstate Highway 280 in Cupertino early Wednesday morning, according to the California Highway Patrol.

Officers responded at 1:18 a.m. to a crash reported on southbound Highway 280 north of Stevens Creek Boulevard and arrived to find a silver Kia Soul on the right-hand shoulder with a civilian performing CPR on someone who had been ejected from the vehicle, CHP officials said.

Investigators determined the Kia was traveling south on the highway when a silver Hyundai driven by Anthony Lipscomb rear-ended the Kia, causing it to swerve off of the highway and hit a tree, with the impact ejecting the driver onto the dirt shoulder, according to the CHP.

After conducting field sobriety tests, officers determined Lipscomb was under the influence of alcohol and took him into custody.
