Cal Poly Student Allegedly Filmed Men in Bathrooms

A Cal Poly Pomona student was arrested after a Santa Ana City Hall employee discovered a camera phone recording video in a City Hall men's room Friday. Police also suspect the man of recording in a Cal Poly library bathroom Thursday.

A Cal Poly Pomona engineering student was arrested Friday on charges of videotaping men using bathrooms at Santa Ana City Hall and is accused of the same at a Cal Poly bathroom.

An investigation continued Tuesday following the arrest of 23-year-old Miguel Ruiz Fabian, who is believed to have filmed men using a library bathroom on the Cal Poly campus, Santa Ana City Hall, and Mile Square Regional Park in Fountain Valley, according to Santa Ana police Cpl. Anthony Bertagna.

Fabian, who was an intern in the Santa Ana Public Works Department, was discovered videotaping in a third-floor bathroom by a Santa Ana City Hall employee Friday, who "saw something odd on the floor" and picked it up to find that it was a camera phone belonging to Fabian, Bertagna said.

Fabian demanded the phone back but the city employee refused and took it to police, who allegedly found 64 videos of men using the same City Hall bathroom, Bertagna said.

Police have sent the phone to a lab in Orange to mine the device for more evidence and it was not known if Fabian sent the videos to others or posted them online.

"As it stands now these are 64 misdemeanors," Bertagna said.

If investigators discover that any of the photos were distributed online or to anyone else, Bertagna said, Fabian could face felony charges.

Fabian told police that he has been filming in bathrooms since December, Bertagna said.

Fabian has been bailed out of Santa Ana's jail and charges have not yet been filed against him.
