Manhattan Beach Ocean View Argument Goes To Appellate Court

A Manhattan Beach home built to three stories is obstructing another family's ocean views.

MANHATTAN BEACH, CA – Everyone knows that ocean views increase the value of the property, and in Manhattan Beach it's no different. One Manhattan Beach family took an ocean-view argument with a neighbor all the way to California Appellate Court, according to The Beach Reporter.

Two judges in the 2nd Appellate District Division 2 affirmed the city’s 2012 decision to issue a building permit to Joseph Paunovich and later deny an appeal of that permit, the newspaper reported. The home is on the northeast corner of 25th Street and Highland Avenue, and was built in 2015 in front of the home owned by Nancy and Rosario Armato, according to The Beach Reporter.

As a result of the Appellate Court ruling, Armato must pay for all legal costs associated with the appeal. The Armato's, who have lived in the Manhattan Beach home for 45 years, no longer have an ocean view on the second floor of their home, and now just have a partial view on the third story due to the Paunovich home, which was built to the city's maximum allowable height of three stories, the newspaper reported.
