Sausalito In Court Battle Over Dunphy Park Homeless Encampment

The city claimed that the Dunphy location is unsafe and wants to remove the camp.

SAUSALITO, CA — The status of a homeless encampment in Sausalito's Dunphy Park remains unresolved following the city's filing of a response Wednesday to a request for a temporary restraining order by a homeless advocacy group that opposes the city's plans to move the camp.

The city's opposition was filed in federal court in response to a petition filed Tuesday by the Sausalito/Marin chapter of the California Homeless Union and nine people who live in the camp.

The petition seeks a halt to the city's plan to remove a homeless camp from Dunphy Park to Marinship Park, a separate park about a half-mile away.

In the city's response, they said they have worked with state and county officials since the encampment formed at Dunphy Park in December to find housing for the people there, and that the Dunphy location is unsafe given its proximity to Richardson's Bay and a lack of permanent bathrooms or mobile shower services there.

The Marinship Park location has male and female permanent bathrooms and has a mobile shower service at the site at least twice a week, according to the city.

City officials said the next step is for the court to appoint a judge to hear the case.

"Given that the City is now engaged in a legal process, we will not be commenting further on the status or plans to enforce the no camping resolution and the relocation of the Dunphy Park encampment to Marinship Park," city officials said in a statement Wednesday.
