Pot Illegal For Cultivation In Milpitas Per City
While many Silicon Valley cities have opened the door to marijuana businesses with the hopes of taxing them, Milpitas said no to it.

MILPITAS, CA -- Light up somewhere else. The City Council took the first step to prohibit all
commercial cannabis activity and regulate the cultivation for personal use within its boundaries, the local government announced this week.
The council during a special meeting unanimously approved on a 4-0 vote, with member Anthony Phan recusing himself, a zoning ordinance change. The final adoption of the ordinance is scheduled for the Jan. 15, 2019 City Council meeting.
At its November 20, 2018 meeting, the City Council directed staff to prepare the regulations and
the Planning Commission followed up by approving the proposed zoning ordinance at its Dec. 6 meeting.

There has been extensive dialogue on the topic of cannabis over the last two years before the
City Council, Cannabis Subcommittee and Planning Commission. The city also hosted two community meetings and conducted public surveys last June, which garnered
over 500 responses. Hundreds of emails were received including those associated with a community initiated petition.
California Proposition 64 passed in November 2016, legalizing adult use of marijuana. The law put local jurisdictions on the fast track to determine how to proceed with the wave of interest in the substance. Two months later, the City Council adopted a temporary moratorium on certain cannabis-related activities to put the matter on hold. The temporary moratorium will end with this week's final ban.
