How did measure W get past the costal comission?

Has anyone noticed that the new hotel developmment is right on top of the sea cave at the beach?

There are native american petroglyphs in there that are the only remanent of the latge village that was once here. That place was once their fish camp, and they left art there. Building the hotel where they want it will destroy that area. Did they use the jedi mind trick on the costal comission? I know people who were persecuted by the costal comission for proposing buildings that are nowhere the beach.
