Khloe Kardashian Fireworks Probe Goes Up in Smoke

Investigation into late-night birthday celebration won't ignite criminal charges; D.A.'s office said Kardashians had "passive permission."

The Los Angeles County District Attorney’s Office has decided not to prosecute anyone in connection with a huge fireworks display in the Marina del Rey area in August, it was reported today.

Kris Jenner and Khloe Kardashian arranged for the fireworks show off a yacht off the coast on Aug. 26, a weekday, to celebrate the birthday of Khloe’s boyfriend, the NBA’s James Harden. Area residents were livid at having been awakened.

Law enforcement sources tell the celebrity news website TMZ.com that the Los Angeles County Sheriff’s Department wrapped its investigation into the explosive yacht party and submitted its findings to prosecutors, recommending a misdemeanor charge of disturbing the peace.

But the D.A.’s office rejected it because the Kardashians had “passive permission” to stage the fireworks show.

According to TMZ, the U.S Coast Guard gave the sheriff’s department a heads up that Jenner’s production company would be lighting up the sky that night and didn’t need a permit since the boat was outside the marina.

A number of area residents are believed to be preparing a lawsuit against Kardashian and Jenner.
