Union City Man Convicted of Sexually Assaulting 5-Year-Old Niece A Decade Ago

A Union City man faces up to 17 years in prison for sexually abusing his 5-year-old niece more than 10 years ago, according to the Oakland Tribune.

The Tribune reports that 27-year-old Alejandro Amezcua was found guilty of touching his then 5-year-old niece inappropriately on multiple occasions. Amezcua was 16 at the time of the incidents.

Amezcua originally faced three counts of aggravated sexual assault — including rape, sodomy and forced oral copulation — along with eight felony counts of committing lewd and lascivious acts on a child under 14.

A jury, however, concluded it could not convict Amezcua of the aggravated sexual assault charges, the Tribune reports.

The victim, now 16, appeared in court earlier this month and detailed the alleged acts, which included being forced to watch pornography and re-enact what she saw.

Authorities learned of the incidents in 2011 after the girl mentioned the abuse to a school nurse. As part of the investigation, Union City police recorded a conversation between the victim and Amezcua in which they discussed the alleged abuse. According to the Tribune, Amezcua told the girl during the recording not to tell anyone about the incidents “because you’ll get everyone in trouble.”

After the verdict, Amezcua’s attorney continued to argue that there was no physical evidence to prove that Amezcua committed any of the acts and questioned the girl’s testimony.
