East Haven Man Tired of Waiting on Solution to Zoning Issue

A neighbor's pool is infringing on the man's property, creating problems for his zoning regulation and insurance policy.

Since the deadline for two East Haven residents to come to an agreement over a zoning issue has passed, one of the residents is tired of waiting for a solution, the New Haven Register reports.

Oscar Ovalles was given a permit to in May to build an above-ground pool on his William Street property, however the pool is encroaching on his neighbor, Joshua Onofrio’s property by 5-feet.

According to the Register, the residents had agreed to a land transaction to remedy the situation. However, a land purchase would make Onofrio’s property lose its R-1 zoning regulation. Onofrio’s insurance company has warned him that his policy would be cancelled if the pool remained encroaching.

Ovalles and Onofrio had to come to an agreement by Sept. 26.

Planning and Zoning Director Frank Biancur Jr. told the paper due to an error in the surveying information, Onofrio had been granted the permit.

Another possible solution for the problem was a land swap, however town assessor Michael Milici told the paper this too would render Onofrio’s property non-conforming.

Onofrio told the paper he was open to working with his neighbor on a timely solution but said the timeline was no longer favorable to him. He wants a solution that would not hurt his property.

According to the paper, officials are working with the neighbors to have an application for the proposed solution submitted by Oct. 27. If not, Biancur will issue a cease-and-desist order requiring the pool be removed or moved closer to Ovalles’ home.
