DUI Charge for New Canaan Man Stopped on Richmond Hill Road
Even someone in a stopped car can be charged with driving while under the influence, if a certain condition is met.

Police checked out a report of a person passed out in a motor vehicle stopped on the side of Richmond Hill Road late afternoon on Tuesday, April 7, and found a 31-year-old New Canaan man behind the wheel.
Town police gave this account (an accusation not proven in court) of the incident:
Police found James Mysogland of 651 Laurel Rd. reclined in the driver’s seat, with the car running. An officer immediately smelled alcohol when he spoke with Mysogland and also saw a can of beer in a cup holder.

Mysogland didn’t pass field sobriety tests at the scene, and he was charged with driving while under the influence. (In Connecticut, police can charge someone determined to be intoxicated even if the car they’re in isn’t moving, if the person appears to have been the driver and if the keys are still in the ignition.)
He was released after posting a $1,000 bond and is scheduled to appear April 20 in state Superior Court in Norwalk.
