Troconis Seeks Dismissal Of Charges In Jennifer Dulos Case

STAMFORD, CT — The attorney representing accused murder conspirator Michelle Troconis has filed a new motion in Stamford Superior Court seeking dismissal of the charges, and other remedies, in connection with the Jennifer Farber Dulos disappearance case.

Jon Schoenhorn filed the motion Thursday, stressing that his client is seeking dismissal of the case because the "warrant for arrest was false or recklessly disregarded the truth, and was derived from illegally obtained information." In addition to have the case dismissed, Schoenhorn also is seeking an evidentiary hearing to give his client the chance to "establish the falsehoods and material misrepresentations" by the authorities.

Troconis, the ex-girlfriend of the late Fotis Dulos, and Kent Mawhinney, an attorney and former friend of Fotis Dulos, are accused of assisting Dulos murder his estranged wife, Jennifer Dulos. Jennifer Dulos disappeared from her New Canaan home on May 24, 2019, and is presumed to be dead; her body has not been found, but state police detectives continue to search for her and/or clues to her whereabouts.

Fotis Dulos was charged with kidnapping and murdering Jennifer Dulos, the two of whom were in the midst of an acrimonious divorce and child custody battle at the time of her disappearance. He took his own life in January of last year before he could stand trial.

Authorities accuse Fotis Dulos of disposing bloody evidence from the crime at various locations in Hartford not long after the murder is thought to have taken place.

Troconis was in the vehicle at the time, according to authorities, but Schoenhorn claims the traffic surveillance video footage used to build the prosecution's case does not show his client helping Dulos dispose of any items.

Additionally, Schoenhorn claims the video only shows the vehicle stopping three times along Albany Avenue in Hartford, where Fotis Dulos is believed to have discarded items, and not "over 30" times as alleged by state police.

Schoenhorn also claims that in the warrant, his client is characterized as not cooperating with authorities, when she was represented by counsel from before her initial arrest in the spring of 2019.

"When combining the aforesaid falsehood, material misrepresentation, and the omission of material fact, it is readily apparent that the affidavit lacked probably cause to support the issuance of an arrest warrant even assuming that such cause existed on the face of the affidavit," Schoenhorn wrote in the motion.
