The driver initially identified himself as Lucas C. Ibanez, according to the police report. He was attempting to avoid being collared on a prior arrest warrant from Danbury Superior Court stemming from a DUI charge in Ridgefield. As a result of that arrest, Ibanez's driving privileges had been suspended.

In addition to DUI and other motor vehicle offenses, Wilton police charged Ibanez with second-degree failure to appear. He was released on a $1,000 bond to his sister later the same night, and scheduled to appear in Danbury Superior Court on Oct. 8.
