Milton Terminates Permit For Waste Hauler

Allegiance Sanitation is accused of being behind on fee payments, and not providing the required proof of insurance to the city.

MILTON, GA — The Milton City Council has voted to terminate the permit of a waste hauler that provides trash removal services in the city. Allegiance Sanitation's permit was revoked following a presentation made by Finance Director Bernadette Harvill that outlined areas where the company is not in compliance with city ordinances.

Allegiance is accused of failing to submit the required proof of insurance and the required provider affidavit, Harvil said. The company is behind on payments by six quarters; the last time fees were submitted by the waste hauler was in June 2017 for collections through March 2017, the city added.

Harvill also told the City Council that Allegiance "has a history of chronic late payments, noting that the finance department unsuccessfully continued its attempts to work with the owners in an effort to help maintain their permit."

City Manager Steve Krokoff emphasized that while the past due fees are definitely a concern, the greatest risk to Milton and its residents lies in the fact that Allegiance has failed to submit the required proof of insurance. In addition to being out of compliance with the ordinance, Harvill provided information detailing complaints made by residents to the city since June 2017.

"Customer complaints have included unpredictable pick up; cancellation fees not previously disclosed to the customer; failure to complete final service dates; and refusal to pick up trash bins upon cancellation by the customer," Harvil added.

While the Council voted unanimously to terminate Allegiance's permit on Nov. 19, the Council further clarified that action with a follow-up agenda item during the Dec. 3 Council meeting, again unanimously approving that agenda item terminating the permit for Allegiance Sanitation. This action prevents Allegiance from collecting trash in the city in 2019.

In addition to sending written correspondence, the city attorney attempted to officially serve the owner of Allegiance Sanitation, Kyle Bevis, notice of the Nov. 19 public hearing regarding the possible termination of his waste hauler permit. Bevis was not in attendance at the Nov. 19 or Dec. 3 Council meeting, the city said.

Residents currently receiving trash service through Allegiance Sanitation can continue service through the end of the year or contact the company regarding cancellation prior to the termination of the permit. The termination goes into effect Jan. 1, 2019.

Cancellation of private services and any contractual requirements are managed directly by the homeowner and the vendor. The list of 2019 permitted waste haulers is available on the city's website.
