Woman, 77, Says She'll Shoot Her Husband If He Calls Her Another Name

She suffers from dementia and was arrested and charged under the Family Violence Act.

A woman whose husband says suffers from dementia was arrested Monday after allegedly brandishing and firing an unloaded gun at her husband in anger.

The husband, 70, called police about 3:45 p.m. to their Cassville Road home, telling dispatchers he had taken a firearm away from his wife, Jaynell Earwood Mathis.

She was sitting on the front porch when police arrived and said she and her husband were in an argument and the man called her a "son of a (expletive)," according to the Bartow County Sheriff's Office incident report, above.

"Jaynell stated due to (her husband) arguing with her and calling her names, she became upset," a deputy wrote in the report. "Jaynell said she had the...firearm in her hand and she was going to shoot (her husband) if he called her a son of a (expletive) again. Jaynell said she never pointed the weapon at (her husband)."

She had a black, leather ammo holder and ammo with her when speaking to the deputy and said her husband had been verbally and physically abusive to her in the past.

He told a different story.

The husband said the two had a "great" day and there was no argument or physical altercation between them prior to the incident. He said she went to the bedroom, locked the door and later came out with a bag in her hand.

"(The man) said Jaynell stated you have been hiding my stuff away from me for a long time," the report says. "(He) said Jaynell had the...firearm in her hand and was pointing it toward the ceiling as she was pulling the trigger several times. (He) said he was unaware that Jaynell had ammo for the weapon. (He) said Jaynell never pointed the weapon at him.

"Due to Jaynell having the...firearm in her hand and she admitted that she was going to shoot (her husband), I placed Jaynell under arrest for aggravated assault (under the Family Violence Act)," the deputy wrote.

The woman had a long rifle magazine and .22 bullet in her possession, according to the report.
