City Of Douglasville: Georgia OCGA Section 25-10-2 Pertaining To Consumer Fireworks On Private Property

Georgia law concerning when and where citizens may shoot common consumer fireworks on private property has been changed several times in the last five years, including amendments to OCGA section 25-10-2 in 2015, 2016 and 2018. As a result, numerous obsolete and incorrect information articles can be found on the internet about this subject.

Since July 1, 2018, the law on shooting times is as follows:

1. For certain holidays, Citizens may shoot fireworks on:

2. For all other days, citizens may shoot fireworks from 10:00 A.M. to 11:59 P.M., but the local government may restrict this by enacting or reenacting a general noise ordinance after July 1, 2018. This ordinance may not address fireworks noise separate from other kinds of noise. Enactment of the ordinance must be preceded by publication and a public hearing.     

3. To expand the allowed shooting times, a local government must have an ordinance authorizing it to issue a special use permit that designates the additional time or times and location. The fee for such a permit may not exceed $100.00.  The local government may not have a general ordinance expanding shooting times for everyday use.
