Waffle House: 'Exploding' Plate Didn't Injure Lawsuit Plaintiff

The lawsuit claims a piece of a broken plate at a Roswell restaurant ended up in a man's ear, causing hearing loss.

NORCROSS, GA — Waffle House is denying a Georgia man's claim that a piece of an exploding plate at one of its restaurants lodged in his ear, causing him hearing damage.

In a lawsuit against the Norcross-based breakfast chain, Larry Graham, of Dekalb County, said he was dining at a Waffle House location in Roswell in March 2015, the Atlanta Journal-Constitution reported.

Hot plates that had just come out of a dishwasher were sprayed with cold water, causing them to explode, sending shards of glass through the air, the suit maintains. Graham says a shard from a plate stuck in his ear, and that he pulled a muscle in an arm as he reacted.

In an email to the AJC, though, a Waffle House spokesperson said a video shows Graham was returning from the restroom when a plate was dropped and broken, and that he was nowhere near the area where the accident happened.

Graham is suing for medical expenses, lost wages, pain and suffering, mental anguish and other expenses.
