Decatur Faces Annexation Lawsuit

An anti-annexation group is suing the city of Decatur for an annexation along Midway Road.

Two members of an anti-annexation group have filed a lawsuit against the City of Decatur for its annexation of five properties along Midway Road nearly two years ago, claiming a signature on the original petition is invalid.

The group, called No2Decatur, claims one of the signatures on the original annexation petition does not belong to the actual homeowner and is therefore, invalid, according to the Atlanta Journal-Constitution.

Decatur approved the annexation of five properties along Midway Road in March 2013, the news outlet reports. The method used for the annexation required the signatures of all homeowners whose properties were involved

Eunice Elise Young, a member of No2Decatur, lives at one of the five properties along Midway Road that Decatur annexed. She says one of her neighbors’ signatures on the petition is not valid, according to Decaturish. Young says the property owner’s wife, who is not the property owner, signed the petition.

The lawsuit seeks to set aside the annexation and to prevent Decatur from annexing any contiguous properties, according to Decaturish. Young reportedly also wants a refund of taxes she has paid to the city.
