Vallow Prosecutor Withdraws Argument In Competency Findings

REXBURG, ID — The prosecutor in the Lori Vallow Daybell case has withdrawn his argument regarding the findings of a recent competency evaluation finding Vallow "not competent to proceed" in further court proceedings.

Vallow's defense attorney, Mark Means, requested the evaluation in March. A clinical psychologist met with Vallow in the Madison County Jail on two days, writing she was "not competent to proceed." In response, Prosecutor Rob Wood originally filed a contest to the findings, but has now rescinded his argument.

Vallow, along with her husband Chad Daybell are charged with multiple counts of conspiracy to murder, first-degree murder and other charges in the death of her two children-Joshua "JJ"Vallow and Tylee Ryan-and the death of Daybell's first wife, Tammy Daybell.

The case against Vallow is now on hold as Judge Steven Boyce has not made a ruling if Vallow is unfit for trial. Under Idaho law, judges can place hearings on hold for 90 days.

In similar cases, defendants are usually placed in a facility for "restorative treatment" until a defendant is found competent to understand the charges they face and be able to assist in their own defense. If unable to do so after the initial 90 days, an additional 180 days can be ordered.
