Batavia Restaurants Warned For Indoor Service Amid Restrictions
The eateries could face orders to disperse or misdemeanor charges if they continue serving customers inside, according to city notices.
BATAVIA, IL — At least two restaurants in Batavia have received written notices from city officials for serving customers inside despite new regional coronavirus restrictions, the Kane County Chronicle reports.
Apple Villa and Briana’s Pancake House were warned Friday that they are defying the new restrictions, which ban indoor service at restaurants and bars, the report states.

The warnings, delivered by Batavia police, told the businesses “it is imperative that you take the necessary steps to address non-compliance with state guidelines immediately, or as soon as is reasonably practicable,” the Chronicle reports.
Both Batavia businesses could face orders to disperse or misdemeanor charges if they continue to serve customers inside, the report states.

Geneva Restaurant Sues To Stay Open Under New Restrictions
FoxFire Restaurant in Geneva is suing Gov. J.B. Pritzker, the Illinois Department of Public Health and the Kane County Health Department to continue serving customers indoors after announcing last week it would defy the new restrictions.
State officials imposed new restrictions Friday on Region 8 (Kane and DuPage counties) and Region 7 (Will and Kankakee counties) after positivity rates in those two regions eclipsed 8 percent for three straight days.

The state's regional coronavirus-mitigation strategies include a ban on indoor service at restaurants and bars, as well as a cap on the size of public gatherings.

The increased mitigations do not include any new restrictions on retail stores, salons and personal-care businesses, or group recreational activities.

Public health officials will lift additional regional restrictions once those positivity rates drop below 6.5 percent for three days in a row. State officials could implement "Tier 2" mitigation strategies if regional positivity rates remain above 8 percent for 14 days.

Tier 2 mitigations would include further limitations on in-person dining and social gatherings, a ban on indoor recreational activities, new restrictions at hospitals, and a return to curbside pickup from retail stores.
