According to the police report, a 37-year-old Darien man was driving about 9:30 p.m. March 14 in the 6700 block of Crest Road when he was about to pass a parked car with several people standing outside. As he approached, a man, later identified as Rivera, stepped in the car's path, police said. The Darien man got out of his car, walked to the group and asked what their problem was.
Rivera then got close to the Darien man, threatened to beat him up and asked him whether he wanted to die, according to the report. He then told the man that he would shoot him, police said.

The Darien man was about to walk away when Rivera grabbed him with both hands, spit in his face and then punched him in the upper body, the report said. The Darien resident returned a punch, and they ended up rolling around on the ground in the middle of the street, police said.
The Darien man got up and called the police. As a result of the fight, he suffered a cut to a finger, a sore back, a scratch in the middle of his upper forehead and some redness to both sides of the face, police said. He refused medical attention.
Rivera denied hitting the Darien man, but one of his friends said Rivera did, police said.
Rivera also told officers that he knew what they did to people like him and repeatedly asked them not to shoot him, according to the report. With officers nearby, Rivera urinated on the road, police said.
At the police station, Rivera was at times aggressive, calm, insulting and laughing, the report said. At one point, Rivera reached over the booking counter and grabbed at paperwork in front of officers, police said.
While in a holding cell, Rivera told officers that his uncle was a lawyer and that he would sue everyone, according to the police report. He also told one officer repeatedly that he was "going to (expletive) his daughter," police said. With his back to officers, Rivera urinated over the group cell bench and floor, police said. He had not requested use of the bathroom before this.
The police report stated that Rivera is a security guard with a Naperville security firm.
