2 Residents Accused of Attacking 16-Year-Old Girl, Stealing Her Pot

Tanner J. Smith and Desiree Smith were charged Thursday with robbery, battery and mob action, according to the Batavia Police Department.

The following press release is from the Batavia Police Department:

On Tuesday, October 7, 2014 at 7:56 PM, Batavia Police Officers were approached by a 16 year old female subject from Batavia who alleged that she had just been the victim of a Robbery while walking in the 1000 block of Pine Street. The victim stated that a small black vehicle had pulled alongside her at which point two subjects exited the vehicle. The victim recognized the two subjects as former acquaintances. The subjects were Tanner J. Smith, 21 years of age, and Desiree L. Smith, 21 years of age, both of 741 N. Van Buren Street Batavia, IL.

T. Smith and D. Smith approached the victim and immediately began using their hands to strike the victim about her body as she attempted to escape. During the assault, D. Smith forcibly removed a bag of cannabis from the victim’s person. T. Smith and D. Smith then returned to the vehicle and left the scene of the incident. Officers immediately searched the area and were unable to locate the offenders or the suspect vehicle. The victim was treated and released at the scene by medics. Issues regarding the possession of cannabis by the victim are being handled at the local level.

After additional investigation, the Kane County State’s Attorney’s Office was contacted and the following charges were authorized against T. Smith and D. Smith:

  • Robbery – Class 2 Felony
  • Mob Action – Class 4 Felony;
  • Battery (2 Counts) – Class A Misdemeanor

On Thursday, October 16, 2014, Officers located both offenders and took them into custody.

Both offenders were transported to the Kane County Jail where they await a bond hearing.
