Not Guilty: Glen Ellyn Man Acquitted in Attempted Murder of Father

But he was found guilty of battery and still faces prison time

On Thursday, a DuPage County jury found Charles Mitchell not guilty of trying to kill his father, but they found him guilty of aggravated domestic battery, according to the Daily Herald. Mitchell faces three to 14 years in prison for the incident that occurred at a Glen Ellyn hotel last June.

Mitchell was charged with attacking his brother and father at a hotel on the 600 block of Roosevelt Road. He allegedly hit his brother in the face and gouged his eyes before kicking his father in the head and body.

In the trial, Mitchell represented himself and claimed that he acted in self-defense against his 61-year-old father.

“My dad was no slouch. He was a strong man. If I had allowed him to hit me, it could have been me in that situation,” Mitchell told the jury, according to the Daily Herald.

The prosecution dismissed his claim.

“That’s pure baloney. The truth is that (Mitchell) was in a blind rage. He was so upset that he beat his father,” Assistant State’s Attorney Bethany Jackson said, according to the Daily Herald.

Mitchell is due back in court on April 7, when his sentencing date may be set.
