Legal Blow Doesn't Mean Fight to Stop Mission Hills Development Is Over

Letter to the Editor: Resident says the courts will re-examine the case despite most of a lawsuit against the builder being thrown out.

Brian Hoffman, Red Seal vice chairman, said in a press release following the ruling that Judge Novak threw out 4 of the counts of the Mission Hills lawsuit, "This decision puts an unnecessary lawsuit behind us and lays to rest any lingering question the neighbors may have had about the development."

Lest you speak too soon, Mr. Hoffman, it appears Judge Novak has second thoughts about how the Cook County decision process was handled as are many decisions made by Cook County that you rely upon.

She has called into question core issues of the lawsuit and is considering re-entering previous documents that she struck.

Since 4 counts of the Mission Hills suit were thrown out, this ruling now leaves open the opportunity for the Mission Hills lawyers to address the issues that will be reinstated, thereby allowing counts and issues to be re-examined.

In following the current events of the day, my perspective is that your arrogance rivals that of Republican front runner for the nomination of candidate for the presidential election.

Continuing that theme, is it legal and ethical to mislead by publishing that you’re breaking ground at Mission Hills with the intent to collect deposits when you haven’t yet procured the necessary permits to date, have not put a shovel into the ground as your visual ads depict while you are still in litigation regarding the proposed development?
