The Holiday season is upon us and research shows DUI's are more prevalent during the holiday season do to celebrations and family gatherings. Here are a few important facts you should know about Indiana DUI law and what the consequences are of driving under the influence.

  1. Penalties for a first time DUI Offender range from 0 days in jail to one year.
  2. Fines can go up to $5,000, and a license suspension for up to two years.
  3. Third time DUI charges can result in up to 10 days in Jail to three years.
  4. Third time offenders can be fined up to $10,000, and a maximum 2 ½ -year license suspension.
  5. Effects of having .08-.10% or more of BAC include; poor muscle coordination, Clear deterioration of reaction time and control,impaired perception, and reduced ability to maintain lane position and brake appropriately.
  6. A BAC of .08% or higher will result in a DUI according to Indiana law.
  7. Traffic stops increase during the holiday season which is Thanksgiving to New Years Eve/Day.
  8. Fines and penalties will increase if a driver is underage and driving under the influence.
  9. Driver can deny a breathalyzer test, however, failing a chemical test can result in a higher penalty.
  10. Driving under the influence with underage passengers in the car can all lead to higher penalties including, higher fines, license suspension and even jail time.
