Trial Delayed For Noblesville School Shooting Suspect

Attorney of Noblesville West Middle School shooting suspect asks judge to delay trial, scheduled for June 25 to 26.

NOBLESVILLE, IN — Hamilton County Circuit Court Judge Paul Felix has delayed the trial of the teen accused of shooting a student and teacher on May 25 at Noblesville West Middle School. The Indianapolis Star reported the 13-year-old boy's attorney asked Felix to reschedule the June 25 to 26 "fact-finding hearing" as it's called in juvenile court, for the teen.

A new date hasn't been scheduled, according to a court official, who added that trials are usually delayed in cases like this one when there is a lot of evidence involved.

Patch reported at the beginning of June that Hamilton County Prosecutor D. Lee Buckingham announced he filed a petition Tuesday in juvenile court against the 13-year-old suspect in the shooting, in which he also released the suspect's name, David Moore.

In a June 5 statement, Buckingham addressed why the suspect cannot be charged as an adult, though he alleges the teen "committed acts that would be felony or misdemeanor crimes if committed by an adult."

On Friday, May 25, authorities say Moore opened fire inside a classroom at NWMS, shooting seventh-grade teacher Jason Seaman and 13-year-old student Ella Whistler.

Seaman was shot three times as he threw himself into the line of fire, swatting the gun from the shooter's hand. He's since been released from the hospital, while Whistler's family says the teen faces a long road to recovery after being shot seven times.

Buckingham adds that the shooting investigation remains ongoing.
