Owner of Capone Bros. In Canton Accused Of Threatening Employee
The Department of Labor says Charles Capone went after an employee who he suspected of assisting with a federal investigation.
CANTON, MA — The owner of Capone Bros. Inc., a contracting company based in Canton, threatened a former employee who he suspected of assisting with an investigation into unpaid overtime wages, according to Department of Labor (DOL) Secretary Marty Walsh.
Charles Capone is accused of threatening to "go after" the former employee after the DOL determined that employees at the company were owed unpaid wages.
According to a lawsuit, Walsh said Capone made false accusations about the former employee to her new employer, calling her "sneaky" and "a thief" and forced other employees to either admit to being a DOL informant or say they worked fewer overtime hours than determined by Walsh's investigation.

On Monday, a Massachusetts federal judge granted the preliminary injunction against Capone, ordering him not to violate the Fair Labor Standards Act by retaliating or discriminating against any current or former employee or filing any complaints against them.
Capone was also ordered to post a copy of the order at each worksite and provide each worker with a written copy within two weeks.
