Boston Marathon Bomber Seeks New Trial Tuesday

Dzhokhar Tsarnaev's lawyers are expected to argue his trial should not have been held in Boston.

Boston Marathon bomber Dzhokhar Tsarnaev is scheduled to have his plea for a new trial heard in federal court Tuesday.

Tsarnaev is not expected to attend the hearing, during which his lawyers are expected to claim that the convicted bomber’s original trial should not have been held in Boston because there would be no way to seat an objective jury in the city.

Tsarnaev was sentenced to death earlier this year after being convicted of carrying out the terrorist act during the 2013 Boston Marathon.
