Waxy O'Connor's In Foxborough Expected To Be Sold

Waxy's must pay $6,000 in outstanding fees to the town and remove any alcohol still at the pub before the license can be transferred.

FOXBOROUGH, MA — Representatives from the Irish pub, Waxy O'Conner's told the board of selectmen on Tuesday they expect to sell the restaurant on Main Street after closing on Dec. 26 for health code violations.

Health department officials shut down Waxy's after their inspection discovered perishable foods being delivered in non-refrigerated vans, a moldy fridge, and a bar without cleaning products. Waxy's responded by closing. Pub representatives argued the town acted punitively and made it impossible to stay in business. The health department has continued to dispute this, arguing that Waxy's is a repeat offender and has failed to show up to any of its hearings before the health department.

Site manager and Waxy's business partner Paul McKenna, as well as attorney Frank Spillane, appeared before the selectmen for the public hearing to determine if Waxy's liquor license would be rescinded. Spillane told the board the pub chain has been searching for a buyer and was hoping to transfer the license, the Sun Chronicle reported. On Thursday, Spillane had plans to meet with a prospective buyer and was hoping to have a deal in place after the meeting.

The board of selectmen voted to withhold the license for six months while Waxy's looks for a buyer. The license can then be transferred to a new business, under one stipulation. Waxy's must pay $6,000 in outstanding fees to the town and remove any alcohol still at the pub.
