Fatal Route 109 Crash: Driver Pleads Not Guilty
The 41-year-old Upton man pleaded not guilty to a host of charges relating to a November crash that killed a Falmouth man.

MEDFIELD, MA — The Upton man who prosecutors said caused a fatal November crash on Route 109 pleaded not guilty to a host of charges. Andrew Holman, 41, was behind the wheel when his Jeep which sparked a fatal chain reaction resulting in the death of a 31-year-old Falmouth man, the Norfolk County DA's Office said.
Prosecutors said Holman struck and was speeding down 109 when a vehicle driven by a Medway woman served to avoid him. The woman's vehicle struck a 2008 Chevy Impala driven by James Tobia, killing him. The woman was hospitalized with injuries, and Holman was flown to a hospital.
Holman allegedly struck a vehicle about a mile east of the fatal crash.

Holman pleaded not guilty Monday to motor vehicle homicide by reckless operation, four counts of assault and battery with a dangerous weapon, four counts of assault with a dangerous weapon, two counts of leaving the scene of a crash involving property damage, failure to stop for police, speeding, and other traffic violations.
Holman was released on personal recognizance, but was ordered to stay away from and have no contact with the victims and family of the deceased victims; not to drive; to continue and comply with any and all mental health treatment; take medications as prescribed; and sign and not rescind all releases necessary for probation to monitor said treatment.

Holman is scheduled to return to court March 30.
