The family of a Somerset girl who choked to death on a marshmallow at a birthday party filed a lawsuit alleging negligence by the hosts.

SOMERSET, MA — The family of a Somerset girl who choked to death on a marshmallow at a birthday party earlier this year filed a lawsuit alleging negligence by the hosts.

Azriel Estabrooks died in April, a few days after the choking incident.

The lawsuit was filed Monday, the Associated Press reported.

Estabrooks' parents claim the party hosts didn't supervise their daughter enough.

Estabrooks was a student at North Elementary School in Somerset. Her family called her a "beautiful little girl."
