Owner Of Proposed Asphalt Plant Sues Town Of Seekonk

The lawsuit was filed last week after the town's board of health moved to ban hot mix asphalt plants.

SEEKONK, MA — The owner of a proposed hot mix asphalt plant in Seekonk has sued the town following a meeting a which the board of health moved to ban the structure, reported NBC 10 WJAR.

According to court documents, International Paving Corporation filed the lawsuit last week in Massachusetts Superior Court.

At a meeting on Wednesday, The board of health voted to call hot mix asphalt plants a "noisome trade," meaning they are dangerous to public health, and banned the plant proposal planned for Industrial Court, which borders a residential neighborhood.

The attorney of the proposed plant owner said the site will be overseen by state and federal regulators and that they are asking the court to issue a decision against the board of health's declaration.
