ABCC Advisory Restricting Retail Licnsees to 25% Capacity Limit

These limits are in effect until January 10, 2021, unless further extended by the Governor.

On December 22, 2020, Governor Charlie Baker issued an Order restricting the number of patrons allowed in retail licensees’ premises to 25% capacity limit. This includes licensees that sell alcohol for consumption both on- and off-premises. A summary of the Governor’s Order can be found HERE.

Beginning at 12:01 a.m. on Saturday, December 26, 2020, all retail licensees are restricted to a 25% capacity limit. This applies to indoor and outdoor seating separately.

The 25% capacity limit is calculated by the occupancy load as stated on a licensee’s certificate of inspection issued under the State Building Code. Workers/staff are excluded from the occupancy count.

These limits are in effect until January 10, 2021, unless further extended by the Governor.

As always, all licensees must ensure that they comply with the laws of the Commonwealth of Massachusetts, and that sales of alcoholic beverages take place only as authorized by federal, state, and local law.
