City Amends Ordinance on Billing for Water and Sewer Charges

AN ORDINANCE TO AMEND ARTICLE I. GENERAL, OF CHAPTER 94. UTILITIES, OF THE SALINE CITY CODE TO PROVIDE FOR AN EXTENSION OF TIME FOR THE PAYMENT OF THE BILLING FOR WATER AND SEWER CHARGES IN EXCESS OF ORDINARY USAGE CHARGES CAUSED BY FAULTY EQUIPMENT WHICH HAS BEEN REPAIRED OR REPLACED TO THE SATISFACTION OF THE CITY,WITHOUT PENALTY OR INTEREST.

            THE CITY OF SALINE ORDAINS:

 

            SECTION 1.            That Sec. 94-2, of Article I. General, of Chapter 94. Utilities, of the Saline City Code is hereby amended by adding at the end thereof the following:

 

“The due date for the payment of the billing for water and sewer charges in excess of ordinary usage charges caused by faulty equipment which has been repaired or replaced to the satisfaction of the city shall be extended, without penalty or interest, for a period not to exceed the next regular billing date or such further extension as the city manager may approve for good cause shown, and be due and payable in equal installments established by the city billing department and agreed to in writing by the applicant for this extension.  Default by the applicant in any of the agreed upon installment payments shall terminate the extension agreement and cause all amounts due and owing the city for water and sewer services to become immediately due and payable, including penalties            and interest.”

 

SECTION2.            Repealer.

All ordinances or parts of ordinances in conflict with this ordinance are repealed only to the extent necessary to give this ordinance full force and effect.

SECTION 3.            Severability.            Should any section, subdivision, clause or phrase of this ordinance be declared by the

courts to be invalid, the validity of the ordinance as a whole, or in part, shall not be affected

other than the part invalidated.

SECTION 4.            Savings.

All proceedings pending and all rights and liabilities existing, acquired or incurred at

the time this ordinance takes effect are saved and may be consummated according to the law in

force when they were commenced.

SECTION 5.            Effective Date.

This ordinance shall be published in the manner required by law and shall become

effective 10 days after the date of its publication.
