A grieving father who was caught on video in a Detroit courtroom as he punched one of the defendants convicted in his daughter’s death won’t face charges.

Video of the brawl inside the Frank Murphy Hall of Justice, captured by WDIV-TV, has gone viral. It has been liberally shared in the United States and around the world.
The fight on Wednesday, Aug. 26, was quickly quieted by Wayne County sheriff’s deputies.

Dwayne Smith, the father of 3-year-old Jamila Smith, was about to give a victim impact statement when he instead hit defendants Clifford Thomas in the head.
Gordon’s attorney, John McWilliams, said the scene was “pretty scary,” according to the Detroit Free Press.
Smith wasn’t allowed to return to the courtroom after a break, and another family member gave the victim impact statement.
“No charges were pursued against those involved as the judge declined to hold Dwayne Smith in contempt of court,” Paula Bridges, a spokeswoman with the Wayne County Sheriff’s Office, said in an email to the Free Press. “Clifford Thomas refused prosecution of Smith.”
Gordon was sentenced to 7-15 years in prison for involuntary manslaughter, and 14-25 years for first-degree child abuse as an aider and abettor, the Free Press said. The terms will be served concurrently, according to Wayne County Prosecutor’s Office spokesman Maria Miller.
Thomas was sentenced to 6-15 years in prison for involuntary manslaughter, and 1-2 years for resisting and obstructing a police officer, Miller said.
