Weber Grill Gets Outdoor Liquor License without Restrictions

The Arnold Liquor Board recommended to allow four businesses to sell alcoholic beverages at the beginning of the summer.

The Arnold City Council approved the following businesses recieve specific liquor  licenses for the following businesses.

  • at 1919 Richardson Rd. recieved a liquor tasting license
  • Weber Grill at 3930 Vogel Rd. will recieve an outdoor patio license for with limited outdoor serving license. The license would only allow serve liquor until 9 p.m. Sunday-Thursday, and until 10 p.m. on Fridays and Saturdays.
  • , 3946 Jeffco Blvd., recieved a outdoor patio liquor license
  • Arnold Jaycees recieved a permit to sell alcoholic beverages at the Arnold Days celebration.

Ward 4 Councilman Ken Moss said he disagreed with the limited hours for Weber Grill because none of the other businesses with outdoor patio liquor licenses have similar limited hours."This is very un-business friendly."

"I don't think they should have any provisions when no other business has that provision," Moss said during a City Council meeting at City Hall on June 7.

Moss said he voted for the permit because he wanted the business owner to have some kind of liquor license.

City Attorney Bob Sweeney said a residental neighbor, who lives within 150 feet of Weber Grill, attended a liquor board meeting and said he was concerned about the possible crowd noise from the patio into the neighborhood.

"We want to accomodate a business but this is the first time a resident (attended a liquor board meeting) and expressed a legitimate documented concern," Sweeney said.

Ward 2 Councilman Bill Moritz said "This is a reasonable compromise, it allows the business to open and if there's no problems we (the City Council) can revise the permit."

The council initally voted 5-3 to approve the liquor license for Weber Grill with Ward 3 councilmen Paul Freese and Phil Amato, and Ward 2 Councilman Michelle Hohmier voting against the permit due to the restrictions on the business.

Moss then asked the council to re-open discussion about Weber Grill's liquor license.

During the second discussion period, Hohmeier said there seemed to be a double standard, neighbors can have parties and drink liquor in their backyards until 11 p.m, due to the nuisance ordinance, but the liquor license for Weber Grill sets a restriction to 10 p.m.

She suggested the business be allowed to serve liquor outdoors until the 11 p.m. match the city's nuisance ordinance.

Although the compromise failed to satify Moss, Hohmeier said the deal would allow the business to serve liquor outdoors for another hour and provide it an opportunity to lift the restriction in the future.

Sweeney suggested the council approve a provisional license without additional restrictions on the serving alcohol outdoors. If there are problems, then the council can revoke Weber Grill's outdoor patio liquor license.

Moritz said, the concerned resident is from Ward 2. "The resident attended the liquor board meeting, the business did not, we (the liquor board members) addressed the resident's concern," Moritz said about the original permit.

The council's final decision, in a 6-2 vote, approved a provisional outdoor liquor serving license without restrictions for Weber Grill. Moritz and Ward 1 Councilman Christine "Cricky" Lang voted against the provisional license.
