Car Accident FAQ's

Many car accident victims do not have sufficient knowledge about their rights, and what they need to do in order to receive fair compensation for their injuries and losses. Here are  the answers to some questions frequently asked by those involved in car accidents.

Do I need to hire a lawyer?
Though it is not mandatory for a victim to hire a car accident attorney, is highly advisable. An attorney has the ability to analyze your car accident case, and determine fair compensation for the losses you have suffered from a legal standpoint. They can protect a victim’s rights and represent his interests in negotiation with the insurance company.

What should I do when the insurance company makes a settlement offer?
Before you jump on the first offer made by the insurance company, it is a good idea to speak with an attorney. This is important because insurance adjusters usually make every effort to settle the case for the lowest possible cost to the insurance company. A good attorney will ensure that you get the best possible compensation for your loss. If you accept the first offer made by the company, you will not have a second chance to recover any future expenses that may occur.

How much compensation will I receive?
Compensation in case of car accidents depend on a number of factors including the severity of your injuries, mental and physical pain, suffering, the cost of medical treatment, financial loss, wage loss, loss of earning capacity, and physical disability or disfigurement. So, it is hard to calculate what exactly your case is worth. This again is an important reason why contacting an attorney would be in your best interest.

Will I have to go to court?
Most car accident cases do not go to court. They are settled through mediation, negotiation, or arbitration. However, if the case is complex, and is not reaching an amicable settlement, it will go to court.

When should I contact an attorney?
It is advisable that a victim speaks to an attorney as soon as possible after the accident. The victim should make it a point to consult with a lawyer before speaking with the insurance company. There is time limit before claims should be filed, and any delays would only jeopardize your chances of a fair recovery. The longer you delay, the tougher it would be to gather evidence and find eye witnesses. The sooner you contact an attorney, the better change you have of getting fair compensation.
