Man Pleads Guilty to Insurance Fraud

Milford man lied about burglary to collect insurance check.

A Mildford man accused of staging a burglary and defrauding his insurance provider will serve time in jail and pay a fine after pleading guilty to a felony insurance fraud charge.

Joshua Calaguiro on Thursday pleaded guilty in Rockingham County Superior Court to the charge stemming from an investigation into the alleged burglary on Oct. 16, 2012.

Calaguiro reported his home with then-girlfriend Heather Spain was burglarized while they were at work and more than $11,000 worth of possession taken – including a $7,400 diamond engagement ring. Calaguiro reported the theft to his insurance agent and the company, Safety Insurance, paid him on the claim. Police investigated the burglary claim, but it remained unsolved.

About six months later, on April 28, Spain told Milford Police she believed Calaguiro staged the burglary. She said the couple recently decided to separate, and that while she was packing her belongings to move out, she found a box containing some of the items that Calaguiro had reported were taken during the burglary.  

Milford Police investigated and found many of the items reported as part of the insurance claim inside the house. On May 1, Calaguiro told police he and Spain had staged the burglary in order to obtain the insurance payment to pay for his daughter’s medical treatment. Investigators did not find evidence to substantiate Calaguiro’s claim that Spain was involved in staging the burglary.

As part of his sentence, he will serve 90 days at the House of Corrections, pay a fine of $2,000 with $1,000 suspended, and be placed on probation for one year.  

Although any law enforcement agency can investigate fraud in New Hampshire, insurance companies are required to report any suspected insurance fraud to the NH Insurance Department Fraud Unit for investigation and prosecution.  This investigation was completed as collaboration between the NH Attorney General’s Office and the NH Insurance Department Insurance Fraud Unit.

Calaguiro of Milford, pleaded guilty to one class B felony insurance fraud charge in Rockingham County Superior Court.  As part of his sentence, he will serve 90 days at the House of Corrections, pay a fine of $2,000 with $1,000 suspended, and be placed on probation for one year.
