Exeter Officials Settle Cell Tower Suit

Town officials have settled a federal lawsuit which will make way for the construction of a 105-foot tall cell tower at 8 Kingston Road.

EXETER, N.H. - Town officials have settled a federal lawsuit which will make way for the construction of a 105-foot tall cell tower at 8 Kingston Road. According to Seacoast Online, the tower will have a 6-foot tall lighting rod, making it 111-feet high.

Varsity Wireless was originally seeking to erect a 125-foot tall tower at the site, but reduced its height in the final agreement. Varsity Wireless has an agreement in place with T-Mobile to co-locate on the tower, which will hold up to five antenna arrays.

Varsity Wireless will reimburse the town’s legal costs up to $15,000.

On April 14, both sides filed a joint status report on settlement negotiations in U.S. District Court. Both parties agreed to extend negotiations an additional 21 days to May 7, if no agreement had been reached, the lawsuit would have proceeded.
