Grand Jury: Derry Man Sexually Assaulted Intoxicated Teen
The grand jury has indicted a Derry man charged with getting a teen intoxicated and having sex with the victim without consent.

BRENTWOOD, NH — A Rockingham County Superior Court grand jury has indicted a Derry man in connection with a sexual assault incident against a teen last year. Erik Kluk, 23, is charged with having sex with a 14-year-old after the victim indicated by speech or conduct that she did not consent. According to the indictment, he had administered an intoxicating substance that mentally incapacitated the victim.
The incident occurred around June 27, 2018, in Derry, according to the charges. This month, the grand jury indicted Kluk on two counts of aggravated felonious sexual assault, in addition to one count of felonious sexual assault due to the victim's young age and the age difference between Kluk and the victim.
The two aggravated felonious sexual assault charges are special felonies, each carrying a maximum possible sentence of 10 to 20 years in prison if Kluk is convicted. The felonious sexual assault charge is a Class B felony that carries a maximum possible sentence of 3 1/2 to 7 years in prison if convicted.
