Town OKs Hess Station Upgrade
Owners, however, disagree with covenant regarding possible restriction to hours of operation.

The Hess gas station in Deer Park could soon have a new look if its owners agree to a Babylon Town covenant that gives town officials the ability to restrict hours of operation, if needed.
On June 3, owners of the station at 1800 Deer Park Ave. at the corner of Grand Blvd. went before the townβs Planning Board seeking permission to remove the current canopy and kiosk and replace it with a convenience store, new canopy and new pump island, a Babylon Town spokesperson told Patch.
Planning Board officials approved the proposal but noted the town reserves the right to limit hours of operation, something the town does with all convenience stores, said Ann Marie Jones, planning commissioner for Babylon Town.

βWhen ever we have a convenience store application, the town reserves the right to bring [the owners] back and limit hours of operation should an issue arise,β she said. βBut that does not mean we will. It just gives us the flexibility to do so if needed.β
A town spokesperson said the applicant was in βdisagreementβ with this covenant and as of Wednesday had yet to respond to the town.
