Farmingdale DJ Accused Of Storming U.S. Capitol: Feds
"Smoke out the Capitol, baby," the man said while smoking marijuana in the Capitol during the riot, federal officials say.

FARMINGDALE, NY — A Farmingdale man was arrested Tuesday morning after being accused of participating in the riot at the U.S. Capitol building Jan. 6, the U.S. Department of Justice announced.
Greg Rubenacker, 25, who is a DJ, is slated to appear before a judge via teleconference Tuesday afternoon, the justice department said.
A witness who went to school with Rubenacker submitted a recording on Jan. 11 of a Snapchat story Rubenacker posted to his account, said John M. Mocello, an FBI task force officer investigating criminal activity in and around the Capitol. Rubenacker sent multiple Snapchat videos of him inside the Capitol on Jan. 6 to the witness, Mocello said. Rubenacker also posted videos to his Snapchat story that other users could see, including the witness, Mocello said.

The witness told the FBI that Rubenacker was the man in the videos and that he or she had known Rubenacker for years, the FBI said. Mocello said he showed the witness Rubenacker's driver's license photo and that the witness said the photo matched the person the FBI saw in the Snapchat story.
In the first portion of the video, posted by user "Greg Rubenacker," the Washington Monument is seen behind a crowd with the caption "America is pissed," officials said. The next Snapchat video shows the person recording the crowd following other rioters inside the Capitol, Mocello said. The videographer can be heard saying, "Holy shit! This is history! We took the Capitol!" Mocello said.

In the third video segment, Rubenacker shows his face while standing in what Mocello said he believes is the Capitol Rotunda. Rubenacker was smoking a blue electronic cigarette or vaping device, Mocello said. Rubenacker looked into the camera and said, "America, baby. What a time," the FBI said.
The fourth and final video showed Rubenacker sitting near a painting in the Capitol Rotunda and then pans to show other rioters, Mocello said. Rubenacker, smoking a marijuana joint, looked at the camera and said, "Smoke out the Capitol, baby," authorities said. Other people were sitting near Rubenacker and smoking with him, with one of the others asking, "How many joints we have?" Mocello said. Rubenacker panned the camera back to himself, said, "Hell yeah," and took a puff, Mocello said.

Rubenacker was charged with knowingly entering or remaining in any restricted building or grounds against the law; intentionally disrupting government business; willingly uttering loud, threatening, or abusive language in a Capitol building to disrupt Congress; and demonstrating in the Capitol building, Mocello said.
