Father Of Dead 2-Year-Old Sues Law Enforcement, CPS Workers

The child's mother faces a murder charge and is accused of attacking two police officers.

MAMARONECK, NY — The father of a 2-year-old Mamaroneck girl who died in 2018 is suing police, prosecutors and child protection workers. Stephen Boyd, the father of Gabriella Maria Boyd, claims they did not enforce a court order separating the child from her mother who is accused of killing her.

The lawsuit was filed July 18 in state Supreme Court in White Plains, according to the Journal News.

Boyd claims he has suffered emotional and psychological damage because his daughter's death was preventable.

Cynthia Arce, Gabriella's mother, was charged with second-degree murder, a felony, in the death of her daughter.

Arce is also accused of attacking two police officers and was charged with two counts of attempted aggravated murder, two counts of attempted aggravated assault upon a police officer and two counts of second-degree assault, all felonies.

Prosecutors said, on April 28, Village of Mamaroneck police responded to 507 Chestnut Ave. where Arce lived with her mother and daughter, following a call from Arce's mother, reporting that someone was dying.

Police found Gabriella unresponsive on her bed.

Arce was found in adjacent room and had two large knives, one in each hand, and charged at the officers.
