Should Lindenhurst Approve A Moratorium On 24-Hour Businesses?

LINDENHURST, NY — Village of Lindenhurst officials are considering a new moratorium for 24-hour businesses — such as convenience stores and gas stations — in the area. The law would mean that any new businesses, which are open between 1 a.m. and 5 a.m., looking to come to the village will have to wait for a year.

"The Village of Lindenhurst has put forth a significant effort to support and revitalize the Business District," a notice on the proposed law reads. "As part of these efforts the Village has completed numerous infrastructure improvements to attract business and enhance the appearance of the downtown, including the addition of brick pavers, road reconstruction, drainage, parking, decorative street lighting, planters, and recreational and cultural opportunities."

Any current businesses that operate 24 hours in Lindenhurst will be exempt from the new moratorium as well as any bars, taverns and restaurants that have a special permit. According to village officials, the board of trustees is concerned that the 24-hour type businesses will "detrimentally" impact the quality of life in the area.

As a result, for one year after the effective date of this law, no application for the construction, erection, maintenance, or change of use for a 24-hour business may be filed, accepted, or processed.

"Numerous new projects have enhanced the appearance and character of the Business District Village wide," the notice reads. "The Board of Trustees has also enacted certain zoning amendments to create a more desirable and attractive Business District including the addition of multiple family residences. The Board of Trustees finds that careful consideration is also required to ensure the compatibility of Business District with the surrounding residential community."

Some concerns regarding these businesses include complaints from residential neighbors concerning noise, littering, traffic, lighting, and privacy which could "negatively impact" the community.

The board of trustees discussed the proposed law during a virtual public hearing on Tuesday. The law will become effective after being filed in the office of the Secretary of State.
