Rockland County District Attorney Thomas E. Walsh identified the accused man as Gerard F. O’Sullivan, 60, who is alleged to have confronted his victim in the parking lot and fired several shots at him.

A third man saw what happened and fired his handgun at the shooter, hitting him once in the shoulder, before police arrived. When they arrived, officers found a man with a handgun who ignored police commands to drop the gun. They used a Taser and took the man accused of the shooting into custody, said Haverstraw Police Captain Martin Lund.

The victim was pronounced dead at the scene.

O’Sullivan, of 15 Scarlett Court in New City, was arraigned Saturday by Judge Larry Schwartz in his hospital room at the Westchester Medical Center, Walsh said. O’Sullivan is charged with Murder 2nd, Criminal Possession of a Weapon 2nd, Menacing a Police Officer, Unlawful Imprisonment 2nd and Resisting Arrest.

O'Sullivan was held without bail and a Grand Jury Notice was served on him and the Public Defender. His next court appearance will be 5:30 PM in Haverstraw Village Justice Court.

"My office has been working with the Haverstraw Police Department since this tragic incident took place," Walsh said. "Executive Assistant District Attorney Stephen Moore and Assistant District Attorney Peter Fernandez will be prosecuting this case. Our prayers go out to the family of the victim, Noe Hamer, who was gunned downed in this senseless act of violence."
