NYS Female Public Servants are left out of 2021 State Budget
NYS legislative Employee; Maryann Maltese, after 19 years of good standing service; is without her Employee retirement at large; why?
Albany short changed Female NYS Public officers; once again by not providing the Procedural Process for Women NYS Public Officers to grant retroactive corrective earnings in issuing Earnings. Maryann Maltese, a Tenured Vested; Tier 4 State Legislative Employee; has been without her employee as of right NYS Public Service Employee Earnings as of 2013. I was approved for Unpaid leave in 2013; whereas NYS as the Employer has the Obligation to advise the Employee of a return to duty date; that NEVER occurred. Even as Patronage Staff; whether one is tenured or not; once the Legislature approves Unpaid Leave; that Public Employer has an obligation to either reinstate an Employee or Severance them within service. All Public Employees should understand this. The NYS Constitution implicit determinations are in favor of the Employee at tenure. The Employee Signed an Oath of Office and provided Work related employment services. Date of Entry into service; is an employee's mark of entrance; that can not be changed; even if an employee takes employment within state service in other agencies. Patronage Staff; and Union State Employees ideally are similar in Employer-Employee protections; State Union Staff; most are Union Members (CSEA) whereby a CSEA Member speaks on behalf of the Employee or Employees. However, within the NYS Legislature; the Employee-the "FELLOW" is accountable to collective bargain or to discuss the finalization aspects with who; ohhh NYS State Legislators-aka State Policy Makers.
This intentional deliberate non-compliance on Procedural Processes within Maryann Maltese's Employment files demonstrates exactly where Women stand in State Service-at the bottom. NYS Legislature Enacted State Equality Law of 2019; and within that doctrine; procedural aspects are not in place; disenfranchising Maryann Maltese; as representative of Female NYS Public Officer. Maryann during her tenure; received discriminatory based earnings contracts which requires the Legislature to immediately introduce "Retroactive Corrective Earnings Legislation"; which Maryann asked the NYS Legislature to do (By Placing the Employer on notice-which is proper procedure to the Employee) so. Why is it proper procedure of the Employee; oh Because; NYS Legislature DID NOT reinstate Maryann from the Employer's approval for Unpaid Leave. That alone is additional Employment Violation of the Federal and State Family Leave Acts-why again; Oh-because Maryann didn't take a Paid Leave; nor did she submit an form of notification that Maryann Opted to resign out of NYS Public Service as an Employee of the NYS Legislature.
Maryann Maltese; ran as the Delegate Democratic-Independent Candidate for NYS Assembly in the 2020 Presidential and State Election Cycles. The 12th AD was a Special Election called in 2020; why again-Oh because Andrew Raia resigned in June of 2019; whereby there was NO Assembly Member representing the 12th AD for 18 Months... How long has Maryann Maltese requested her aspects which is approximately 1/2 step below a State Legislator for her As of Right Employee retroactive earnings-it's 18 months. Has Andrew Raia or any Legislator who resigned or left State Service; gone 18 months without their As of Right Retirement aspects? No-none of them.

The same NYS Public Officer Oath that a Legislator signs; so does the State Legislative Employee! There is not justification for NYS Legislative Legislators from the 2021 Class to negate from; NYS Public Servant of the NYS Legislature, Maryann Maltese to be eliminated from her as of Right Employee Benefits. Tier 4-employees of NYS Legislature are vested at 10 years; and if the Legislators choose to end Service; NYS for that tenured employee is required to offer severance; and or introduce "retroactive corrective earnings" to finalize the Employee matters of an Employee. Any State Elected (Governor, the State Senator (James Gaughran) and/or Assemblymember (Keith Brown) are the Policy Makers and as Agents (officers of the Law) are REQUIRED to introduce for Fellow State Legislative Employees-even if I don't reside in NYS. Why again; oh. Because Maryann Maltese already provided Employment Service to NYS Legislature.
Why did Maryann Maltese announce to run for Statewide Offices in 2020? Quite simply; I support the Union Employee in their endeavors coming from a family of such workers and understanding; since my Non-reinstatement into service; Women in Suffolk County; especially women that reside in Western Suffolk are being systematically discriminated against in office. This 2021 Class of NYS Legislators have focused their direction Legislatively speaking on the Rights of Felons-instead of focusing their attention to ensuring that procedural processes within State Equality Law of 2019 are in effect. In avoiding this; the Legislature has place All Female Employees at risk; especially those that might work part-time and may be eligible to receive Health Insurance Premium Coverages. For example, in NYS Public Service; a Part time employee who works 20 hours per week is eligible for Health Insurance by NYS.

This intentional avoidance of NYS Legislature; including Local State Policy makers mentioned; by not introducing my "Corrective aspects"; permits NYS as the Employer to AVOID my Rightful Benefits; including Active or Inactive Health Insurance participation, non-correction of earnings where it is clearly noted the Earnings are 2x less than Male Colleagues; and any other Employee Benefit from date of entry into NYS Public Service; which is officially 1991. Once again; Did Former Assemblyman Andrew Raia; wait 18 months? What has occurred is utilizing State Employee Maryann Maltese; unethically to ensure that Huntington Township Races are secured by the Huntington Republicans. And why is that; oh; Because on March 9, 2021; yes that's recently; my Agreed to appointment by FELLOW NYS Assemblyman Keith Brown; chose to orchestrate a Police Profiling Arrest of Maryann Maltese at his State District office at 75 Woodbine Street, Northport, NY. The premise of the meeting; was to show the Assembly Member my proofs within MUTUAL service; and for Corrective Introductions to occur. Under most Employment situations-Corrective Introductions occur no matter which Political Party the Member is affiliated with; because we are dealing with "State Service". and not "Political Service". Any one have a question on that now? Is it clear-I believe so; however; those Holding Statewide Office presently; seem to state they do not "Know what I'm talking about". But that answer is 18 months old-gets old fast-yes or no? Here's the right answer from Maryann Maltese; the Downstate Regional Manager of the NYS Assembly-Within 30 days; if no administrative measure exists; that Legislation for an Employee is required. Even a Freshman Staff Member should understand the FELLOW aspect of mutual employer-employee Legislative Bill Introductions-and why is that again? Post the answer below. Otherwise; that Member Should Step down as a NYS Legislator. Intentionally avoiding a bill introduction which is the Measure to resolve Employment Matters; is an Ethics Violation at the highest level-immediate grounds for Explusion for Member and/or Staff.
During my tenure; I ensured Fellow-NYS Public Servants who were due retirements or corrective earnings; received them period! Most notable ones; are Isabelle Burnham and the Late James Corrigan. What else did Maltese ensure; the Burial of the late Nicholas Zillas; with his comrades. I'm not exactly clear on why my Own As of Rights are being consistently violated-however; since reported again; that NYS Legislature has missed the Mark in the 2021 Legislative Session; I have had no other choice; but to Commence a Lawsuit with State Court of Claims; Maryann Maltese v. NYS Legislature, et al, and Honorable Andrew Cuomo-to ensure issuances of my rights as Suffolk County State legislators seem to think; Women State Legislative Employees are "Inequal" Still. For over 60 years Male State legislators have voted against Women's Earnings Rights-read the history Ladies; and see it in present day Workings. I have announced; I have every intention of seeking Statewide Office in 2022-but under no circumstances will I tolerate "additional personal property damages" to my Property. I hope that is crystal clear-if Members of the community keep it up; then that Local Precinct-is going to pay you a visit. And why is that exactly; Because No matter what transpires in 2022; I already hold State Officer Peace Status and I do not use it to violate others civil liberties.
My tenure with NYS Legislature requires Legislative introduction and for 18 months; Local State Policy Makers; including Assemblyman Keith Brown and Senator James Gaughran have not introduced for Maryann; a Fellow NYS Public Officer. As A Fellow; I have every right to step on to State Property-just like them.
Andrew Raia resigned 6 months into the 2020 Term of office; leaving the 12th AD without Representation for 18 months of time. How convenient now; I; as a Fellow NYS Public Officer placed NYS as the Employer on notice 18 months ago-but I'm without Corrective Earnings. Did Former Assemblyman Andrew Raia-at his retirement; wait 18 months? Post the answer..Perhaps then; you will understand the Discriminatory differences between Male and Female State legislative Employees whether we are Members or Support Staff.
This action demonstrates just how deep the disregard is for Female State Public Officers even providing for us during Service; my tenure is 19 years-how long was Raia's? Practically the same amount of State Time-again; Did Raia wait for his "as of right" employee benefits from NYS Legislature?
What can be done; Think about your decisions next time you cast your vote or sign petitions for Elected's seeking non-political party nominations. Petitioning in Suffolk to get on the ballot is needed because what 2020 has taught us within State Elections; is Party Political Chairs Make decisions of who is on the ballot. By avoiding signing; the Voter is avoiding having a Choice of Candidate on the Election Ballot.
