Syosset Mall Fight Continues In Courts

A Suffolk County judge will soon rule on Taubman Properties' suit challenging the Town of Oyster Bay's right to sell 53 acres of former Cerros Wire land in Syosset, according to Newsday.

Residents voted 2-1 in August to allow the Town to sell the land for $32.5 million in order to thwart Taubman's plan to develop it into a luxury mall. Read more here.

The suit is in the court of State Supreme Court Justice W. Gerald Asher, who is expected to make a ruling sometime soon. 

Taubman attorney Ronald J. Rosenberg of Garden City told Newsday that Oyster Bay "does not have the legal authority to sell any of its property that is not surplus. The property that the town is trying to sell is undeniably, at this point in time, not surplus."

The town has previously countered that the land is surplus because it is outdated and would be less expense to abandon and sell than maintain as the DPW complex.

The fight over the property has gone on for nearly 19 years now.
