Drunken Driver Made Girlfriend Take Blame For Fatal BK Crash: DA

Christopher Diaz slammed into a motorcyclist at 80 mph then asked his girlfriend to say she'd been driving, prosecutors said.

KENSINGTON, BROOKLYN — A fatal Kensington motorcycle crash was caused by a drunken driver who slammed into the cyclist, ripped his bike in half, then told cops his girlfriend had been behind the wheel, according to prosecutors.

Christopher Diaz, 24, faces manslaughter and conspiracy charges for ramming into Brooklyn motorcyclist Evvon Alexander, 28, on Beverly Road and Ocean Parkway on May 27 about 3:55 a.m., prosecutors said.

Diaz downed more than a six-pack of beer before he slammed his girlfriend's 2014 black Infinity Q50 sedan, at 80 mph, into Alexander's bike, said prosecutors.

Evvon was thrown into the air, over a median and landed between cars parked on Ocean Parkway's service road, according to prosecutors.

Diaz, his 23-year-old girlfriend Jasmin Morales-Cruz, and two passengers quickly agreed to tell cops the intoxicated man hadn't been behind the wheel, said prosecutors.

Morales-Cruz was charged at the time with vehicular manslaughter, driving while intoxicated and as an unlicensed operator, according to police.

But investigators later found tape of Diaz, Morales-Cruz and their two passengers drinking at three different bars and of Diaz climbing into the driver's seat shortly before the crash, said prosecutors.

They also found texts asking the two passengers to say Diaz had not been driving, according to prosecutors.

Diaz, of Brighton Beach, was arraigned Tuesday in Brooklyn Criminal Court on a 17-count indictment that includes assault, reckless endangerment and criminally negligent homicide charges, said prosecutors.

Bail was set at $400,000 and Diaz, who could face up to 15 years in prison, was ordered to return to court on Sept. 23, prosecutors said.

Morales-Cruz will face charges of conspiracy, obstruction of governmental administration, and hindering prosecution charges at an impending arraignment, said prosecutors, but vehicular manslaughter charges were dropped.

"The victim was a father whose family is now devastated," said District Attorney Eric Gonzalez said.

“These defendants allegedly lied to police in order to help the driver of this vehicle to escape justice for slamming into a law-abiding motorcyclist and killing him."
